Nonindustrial Disability Insurance (NDI)

NDI provides eligible employees with disability benefits for a disability or injury that is not work related or a disability due to pregnancy, childbirth or related medical conditions. It is completely paid by the California State University; no employee contributions, enrollment fees, or pre-enrollment physicals are required to be covered. Employees may receive $125-$135 per week, for a maximum of twenty six weeks per illness or injury, depending on status as a bargaining unit or MPP employee.

To be eligible for NDI, you must be a current active member of PERS. You must be in pay status and not separated by a formal leave of absence (compensated employment). Permanent part time, full time or probationary employees are covered by this benefit. NDI is also payable to employees who are appointed half-time or more for one year of service or one academic year or more.

There is a seven day waiting period for NDI. It may be waived if you are confined in a hospital or nursing home. Emergency room care does not constitute hospitalization and will not waive the waiting period. You must exhaust all accrued sick leave before you receive NDI benefits. Any required waiting period may be served while you are receiving leave credits (i.e., sick leave, vacation credit, CTO). If you elect to use vacation time or CTO, you must use all accrued time before NDI benefits are paid.

Voluntary deductions such as credit union loans, savings accounts, bonds, parking fees, health insurance premiums, etc., will automatically be deducted from NDI benefits unless canceled by the employee.

If health benefits are continued, the University will continue its contribution. NDI benefits are considered taxable wages by the Internal Revenue Service. State and federal taxes and Social Security will be withheld. However, retirement contributions are not withheld nor will state service credits, sick leave, and vacation be accrued. If a holiday is observed while on NDI and all leave credits have been exhausted, only NDI payment will be received.

All claims are administered by the NDI office (A section of the Employment Development Department in Sacramento). Determination of eligibility and authorization to pay claims is based on doctor's certification.

For appeal rights, refer to the State of California Office of Employment Development Department (EDD) Nonindustrial Disability Insurance brochure available from HREO. Some claims will be subject to an unannounced home visit by an NDI representative. NDI payments are not affected by other disability or wage loss insurance you may carry.

HOW TO APPLY

Obtain the DE 8051 form from HREO. Completely fill out ONLY the lower half of the form. Have the Benefits Coordinator in HREO complete the upper half of the form. Give the form to your doctor to complete the "Doctor's Certificate" on the reverse side of the form. Your doctor may be any licensed medical or osteopathic physician or surgeon, chiropractor, podiatrist, optometrist, dentist, designated psychologist, an authorized medical officer of a United States Government facility or licensed nurse-midwife or nurse practitioner for the purposes of disability related to normal pregnancy or childbirth.

THE FORM MUST BE MAILED WITHIN 49 DAYS OF THE DATE YOU BECAME DISABLED IF YOU ARE TO RECEIVE CREDIT FROM THE TIME YOU FIRST BECAME DISABLED.

YOUR RESPONSIBILITIES

It is your responsibility to see that the claim form, Doctor's Certificate and any other forms, are filled out COMPLETELY and mailed to the EDD at the address on the form. If any item is not completed on the form, it will be returned for completion, and your benefit payment may be delayed.
