Unit 8 (University Police) and Unit 11 (Academic Student Employees) are exempt from furlough. Unit 6 (SETC, skilled trades) did not agree to furlough.
Non-Exempt Status
Exempt employees, with the exception of Faculty, Physicians, and Attorneys, lose their FLSA (Fair Labor Standards Act) exemption during the week they take a furlough day and become hourly-paid workers (non-exempt) subject to overtime during the furlough week.
Exceptions
In those few instances where staff are required to work on scheduled furlough days due to business necessity, CSUSM management will work with those employees to identify an alternate furlough day within the same work week if possible. If not possible, then an alternate furlough day within the same pay period (but not within the same workweek as another scheduled furlough day) will be identified. All exceptions must be approved in advance by the Division Vice Presidents.

Subject: CSUSM Furlough Implementation
As you know, the California State University is implementing furloughs to help address the significant reduction in state General Fund support for the CSU. A furlough is a mandated period of time off without pay. Furloughs differ from salary reductions and pay cuts in that they are temporary and do not affect employment status, health benefit eligibility or pay rate for retirement benefits. The CSU furloughs are effective August 1, 2009 through June 30, 2010.
This plan does not apply to Unit 3 – California Faculty Association (CFA). CFA members voted to accept the CSU furlough proposal. The CSU and CFA bargaining team will develop a side letter on implementation of furloughs. Additional information on faculty furloughs will be distributed when it is received.
Unit 4 - Academic Professionals of California (APC) and Unit 6 - SETC are not subject to this furlough plan at this time. Additional information will be provided by Human Resources when available.
The monthly pay reduction necessitated by furloughs will be approximately 10.07% for groups affected by this plan (does not include Unit 3 – CFA) and shall be spread evenly over eleven months starting with the paycheck received August 31, 2009 (August pay period).
In developing our furlough calendar, the University considered input from CSUEU, and considered the concerns and suggestions voiced by several staff at the Budget Forums or via email, which included grouping furloughs with other holidays where possible and Spring Break week. For instance, furlough days have been scheduled coinciding with the Labor Day, Martin Luther King and Memorial Day holiday weekends to provide for a four-day break. There has also been a furlough day scheduled for the day prior to Thanksgiving and the Monday following to provide for a six-day break. We also reviewed various campus calendars (academic, campus events, athletics, holidays, etc.) to ensure the operating needs of the University are met.
The adopted plan causes the least disruption to the already publicized fall class schedule, campus events, regulatory/legal deadlines, and student activity programming. This plan also provides campus departments structure in which to manage staff workload, work schedules, and offer adequate levels of service to our students, and direction, guidance and support for employees.
The campus will be open for instruction on furlough days, with the exception of December 31, 2009 (Winter Break) and the week of Spring Break. On furlough days, University Police, student housing, and limited food service options will be open. The Field House (recreation center) is reviewing their schedules and staffing to determine if they may be open. All other administrative offices and the Kellogg Library will be closed. During the week of the Spring Break (March 29 – April 2), the campus will be closed with the exception of University Police. Many services are available online to students, faculty and staff, and those are accessible 24/7.

August Furlough Days
During the month of August 2009, the campus will observe two furlough days. We will observe a campus-wide furlough day on Friday, August 21, 2009. However, the second furlough day will be a “floating” furlough day which an employee must take prior to August 31, 2009. Employees will consult with their managers to schedule this furlough day which must be taken before August 31, 2009. Since an employee may not observe more than one furlough day in the same work week, the “floating” furlough day cannot be observed during the week of August 17 to 21 or August 31 to September 4. If an employee requests to observe their “floating” furlough day prior to August 21, 2009, the employee’s request will be considered a waiver of the 21 day notice requirement. Although consideration will be given to employees’ requests for specific furlough days and such request will be prioritized by seniority, final approval will be based on operational needs.
