The acceptance and use of the Drawings
provided by Cal State San Marcos indicates agreement to the following terms:
1. Use of the information contained on the
Electronic Drawings will be solely at User's risk.User hereby releases Cal
State San Marcos and agrees that Cal State San Marcos will not be liable for
any damages or losses of any kind (including but not limited to damages for
death or bodily injury to persons, injury to property, and any
consequential, special, indirect or incidental damages) resulting from any
error, inaccuracy or effect in, or other problem with, the Electronic
Drawings even if such damages or losses were caused in whole or in part by
the negligence of Cal State San Marcos.
2. Without limiting the geniality of the
foregoing, User acknowledges that the data on these drawings may be in a
standardized or translated format, and that some information may be lost or
rendered useless, and that Cal State San Marcos will have no obligation to
update or modify the information contained on these Electronic Drawings.
3. User accepts all responsibility for
modifying the data contained on these Electronic Drawings as necessary to
run on the users computer.
4. User acknowledges that the Electronic
Drawings, or Project as-built may vary from the version of these Drawings
and Cal State San Marcos will have no obligation to update or modify.
5. User agrees to indemnify and hold Cal
State San Marcos harmless from and against any and all claims, suites,
losses, liability and expenses, including but not limited to reasonable
attorney's fees, resulting from or related to the use of the information on
the Drawings the User or any third party, even is such claims, suits,
losses, liability or expenses are caused in whole or part by the negligence
of Cal State San Marcos.
