FERPA and Confidentiality
Family Educational Rights and Privacy Act
The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. & 1232g; 34 CFR Part 99) is a Federal law that protects the privacy of student education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education. As a result, universities cannot release student's information, including the fact that they are undocumented, except under very specific circumstances, such as a court order. Confidentiality
AB 540 requires that state colleges and universities keep student information confidential. A student's immigration status cannot and will not be reported to U.S. Department of Homeland Security .
