This page is to familiarize the campus community to the procedures of the
Adjudication process.
Adjudication: (n) the act of pronouncing judgment based on the
evidence
presented.Purpose: To provide reasonably quick informal hearings of contested
parking
violations and to ensure that an individual’s constitutional rights are
maintained through access to fair and impartial administrative hearings.
Authority: California Vehicle Code 40215 and 40230.
There are 3 levels to adjudicating parking violations:

Level 1 consists of an appeal/administrative review completed by
the Citation Appeal Board (CAB).

Level 2 consists of an administrative hearing completed by a
qualified hearing examiner (mediator).

Level 3
consists of a court hearing at Vista Superior Court.
Parking violations are legal documents. The Parking and Police personnel who write parking citations are mandated to carry out this authority by the
California Vehicle Code, the CSU Chancellor's office, and Cal State San
Marcos.
Under no circumstances shall a personal relationship with any officer, public
official, or law enforcement agency be grounds for cancellation.
Citation Appeal Board information:
The Citation Appeal Board (CAB) consists of 3 persons who are employed by Cal
State San Marcos but are not affiliated with Parking Services or Parking Adjudication. The optimum members consist of 1 faculty member, 1 staff member
and 1 student. CAB members meet once a month to review citation appeals/administrative reviews. CAB members identities are kept confidential.
