This Timely Warning Bulletin is being issued in compliance with the Jeanne Clery Act and the purpose is to provide preventative information to the campus community to aid members from becoming the victim of a similar crime.
The University Police Department is investigating the report of a rape of a female student in student housing. The crime occurred between the hours of 1 a.m. and 3 a.m. on Sunday, Sept. 3, 2017, and was reported to University Police on Thursday, Sept. 7, 2017. The victim was walking back to her residence with a friend. On the way, they met two males (non-students) whom they invited back to their student housing residence, where one of the males in a separate room raped the victim.

A female student reported using a women’s restroom on the fourth floor of Kellogg Library at approximately 3 p.m. on Wednesday, March 29 when she noticed a man looking at her from underneath the stall partition. After shouting at him, he left the restroom and she immediately reported the incident to University Police, who are investigating.

The suspect and the victim communicated via a social media app with anonymity features. After meeting on campus the suspect drove the victim to Lot B where the rape took place. The suspect then drove her to Craven Circle where he let her go. The victim notified University Police shortly thereafter.

Prevention tips:
No Means No and Yes Means Yes. A person who is intoxicated cannot give consent. Alcohol contributes to sexual assault through multiple pathways, often exacerbating existing risk factors to include beliefs about alcohol’s effects on sexual and aggressive behavior, stereotypes about drinking women, and alcohol’s effects on cognitive and motor skills.
To protect yourself please be mindful of who you allow into to your residence, and where they are allowed to go within the residence. Look out for the safety of your roommates and other members of your community by reporting suspicious behavior.
When you go to a social gathering, go with a group of friends. Arrive together, check in with each other throughout the evening, and leave together. Knowing where you are and who is around you may help you to find a way out of a bad situation.

In coordination with local and county law enforcement, California State University San Marcos (CSUSM) Police Department investigators executed two search warrants and arrested two individuals as part of an on-going criminal investigation of unaffiliated fraternity Tau Kappa Epsilon (TKE) and its CSUSM student members.
In August, the University initiated administrative and criminal investigations of a report of a sexual assault that occurred in May at an off-campus party hosted by TKE. The University has also received additional reports of sexual assaults and other criminal activities including, but not limited to, pervasive hazing, victim/witness intimidation, vandalism, providing illegal drugs and alcohol to minors, and use/sales of illegal drugs including marijuana, MDMA (mollies), LSD, cocaine, prescription narcotics and Xanax (bars).
At about 8 a.m. Thursday, police executed two search warrants at a home located in San Marcos and a home located in Oceanside. During the searches, police seized evidence and property pursuant to the search warrants which will assist in the furtherance of the investigation. Included with the evidence seized were:
Arrested were Brandon Polonia (age 21) and Corey Hobbs (age 24). These individuals were transported to the Vista Detention Facility. Both are CSUSM students.
In investigating the reported criminal activity and preparing and executing the search warrants, the UPD worked in extensive cooperation with the San Diego County Sheriff’s Office, the San Diego County Probation Department, the Oceanside Police Department and the San Diego County District Attorney’s Office. The investigation is on-going.

In compliance with the "Timely Notice" provisions of the federal Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act of 1998, and CSUSM University Police Department's policy, we are issuing this notice of reports and allegations of disturbing acts of violence:
REPORTED INCIDENTS: The California State University San Marcos University Police Department received a report of sexual assault (rape) over the weekend of May 4, 2014 at an off-campus party hosted by the Tau Kappa Epsilon (TKE) fraternity and its members (TKE is not a recognized CSUSM student organization). TKE is also known as "The Kollege Experience." The circumstances of the alleged assault suggest the involvement of date rape drugs and that the assailant is alleged to be a member of TKE. The University Police Department is working with the Oceanside Police Department in their investigation of this incident, which is ongoing.
The university has received additional reports of sexual assaults purportedly involving the Tau Kappa Epsilon fraternity and its members. These additional alleged incidents were described as having occurred on or near the university campus, and at off-campus residences allegedly inhabited by TKE members. Other alleged recent criminal behaviors related to the TKE fraternity include, but are not limited to, pervasive hazing, illegal victim/witness intimidation, harassment and tampering, vandalism, providing drugs and alcohol to minors, and illegal drug use.
Victim/witness intimidation and harassment constitutes illegal retaliation, could result in criminal charges if it interferes with a criminal investigation, and will not be tolerated.
PLEASE BE ADVISED: TKE is not a recognized student organization at CSUSM. However, most of its local members are believed to be current CSUSM students, some of whom are alleged to have engaged in these unsafe and violent behaviors directed toward other CSUSM students. TKE lost its recognition as a student organization in 2005 as a result of underage alcohol use and failure of the organization to maintain academic standing required of recognized fraternities and sororities. All recognized student organizations at CSUSM participate in an advisement and education program. Additionally, recognized student organizations have a responsibility to conduct themselves in a manner reflective of the university's core values including respect, inclusivity and diversity. Recognized student organizations must have organizational policies that are consistent with those of the university including regulations involving non-discrimination and no hazing.
SUSPECT:
Because there has been more than one report, and because of the nature and severity of the alleged criminal behavior, we consider these reports to represent a potentially serious and continuing threat to students and others in the university community, and that conditions may continue to exist that may pose a threat to the campus community into the future. While all reasonable precautions are being taken by law enforcement and the university, it is our duty to warn of possible dangerous conditions on or near the campus. You should carefully consider whether your presence at or near TKE social events and parties could place you in danger of sexual assault, date rape drugs, or similar illegal drug or alcohol use and abuse.
The phenomenon of drugs being used to facilitate sexual assault has been widely reported across the country. The CSUSM Police Department urges the university community to be alert to the possibility and take steps to protect themselves. Date rape drugs, commonly known as Rohypnol, GHB, and Ketamine, can be slipped into an unsuspecting person's drink. Rapid and severe intoxication follows, along with dramatically reduced inhibitions and memory loss. In this condition, anyone can be extremely vulnerable to sexual assault.
To protect yourself, do not leave drinks unattended and be wary of accepting drinks from people you do not know well. To be even more careful, make sure that you open and pour your own drink, and don't share drinks with others. It is also wise to use the buddy system while socializing – when you go out with friends, agree to keep an eye on one another and to go home together. If a friend exhibits symptoms of severe intoxication, and/or date rape drug ingestion, seek medical help immediately. Signs to look for include: dizziness and/or nausea, memory loss, breathing or motion difficulties, acting disproportionately intoxicated relative to the alcohol consumed.
If you or anyone you know has been the victim of such illegal conduct, including threats, intimidation and/or retaliation, please report these incidents to the university, local law enforcement or the California Attorney General's Office (at the contact numbers indicated below).
