Administrative Hearing (Level 2)
All administrative hearings are conducted and reviewed by a qualified hearing examiner. All qualified hearing examiners are independent mediators and are not employees of California State University San Marcos.
If the ticket has been upheld at the first level (Administrative Review), you may request an Administrative Hearing (level 2) within 21 calendar days from the mailing date of the appeal/Administrative Review Determination Letter.
The following requirements must be met before a request is officially recognized. As the requester, you must fulfill the following within 21 calendar days of the mailing date of the Administrative Review Determination Letter (level 1 results letter).
- Complete and return the Request for Administrative Hearing packet
- Deposit the amount of the parking penalty with CSUSM Parking Adjudication.
The Request for Administrative Hearing packet can be completed in the Parking and Commuter Services office.
You may choose a personal conference or a written declaration.
If you choose a personal conference, Parking Adjudication will notify you via US Mail of the date and time of the scheduled administrative hearing. If you do not attend the scheduled administrative hearing, the citation will be upheld and no further arbitration will be available to you.
If you choose a written declaration, Parking Adjudication will notify you via US Mail of the date your written declaration will be reviewed.
Administrative hearings will be scheduled within 90 calendar days from the date of the request.
Parking Adjudication will notify you via US Mail of the results of the Administrative Hearing. If you are dissatisfied with the results of the Administrative Hearing, you may appeal to Superior Court (level 3) within 30 calendar days of the notice date of the disposition.
